TERMS OF SERVICE FOR HEALTHCARE INSIGHT SOCIAL NETWORK

This Terms of Service Agreement (“Agreement”, “Terms”) for the Healthcare Insight Social Network (“Healthcare Insight”) governs the relationship between the platform and its users (members) and any parties interacting with our brands, products, and services. By accessing or using our services, you agree to be bound by this Agreement.

I. PURPOSE AND SCOPE OF SERVICE

1. Purpose: Healthcare Insight is a specialized platform for members to share and exchange in-depth knowledge regarding medical science, pharmaceutical markets, healthcare trends, and professional data.
2. Content: It serves as a space for introducing, researching, and debating clinical solutions, medical technologies, and market insights within Vietnam and globally.

II. ACCOUNT REGISTRATION AND SECURITY

1. User Responsibility: Members are solely responsible for their legal capacity when registering and using the platform.
2. Identification: In compliance with Decree 147/2024/ND-CP, members must provide accurate identifying information. Healthcare Insight prioritizes verified accounts for medical professionals (doctors, pharmacists, analysts).
3. One Account Policy: Each member is permitted to register and use only one (01) official account.
4. Security: Members must safeguard their login credentials. Healthcare Insight is not liable for losses resulting from unauthorized account access due to member negligence.

III. PROHIBITED CONTENT AND CONDUCT

Members are strictly prohibited from utilizing Healthcare Insight for the following purposes:

1. Legal & Political Violations: Opposing the State of the Socialist Republic of Vietnam; undermining national security or social order; or discussing sensitive political matters.
2. Medical Privacy (HIPAA/GDPR Standards): Strictly no posting of patient-identifiable information, medical records, or clinical photos without explicit legal consent.
3. Medical Misinformation: Disseminating unscientific treatments, fake medical news, or content that endangers public health.
4. Intellectual Property Theft: Unauthorized sharing of paid market reports, proprietary research, “cracked” software, or medical databases.
5. Unauthorized Advertising: Direct or indirect promotion of prescription drugs, functional foods, or medical services without prior approval from the Administration and relevant authorities.
6. Professional Misconduct: Harassing, insulting, or defaming colleagues or healthcare organizations.

IV. CONTENT DISTRIBUTION AND RECOMMENDATION ALGORITHMS

1. Content Intake: All medical content, images, and videos are screened via technical tools to detect keywords or data that violate medical regulations or Vietnamese law.
2. Authority-Based Distribution: Algorithms prioritize content from verified medical experts and reputable healthcare institutions to ensure the community receives high-quality insights.
3. Professional Recommendations: Suggestions are based on the member’s area of expertise (e.g., Cardiology, Pharma Logistics) and legitimate engagement history. We do not use sensitive personal data for recommendations.
4. Moderation Mechanism: All distributed content includes a “Report” tool. Upon receiving a report regarding medical inaccuracies or violations, the content will be hidden within 24 hours for expert review.

V. PENALTIES FOR VIOLATIONS

Depending on the severity of the violation, the following measures will be applied:

• Level 1 (Warning): Temporary post suspension and email notification for minor formatting or category errors.
• Level 2 (7-30 Day Ban): Applied for professional misconduct, spreading unverified medical rumors, or spamming.
• Level 3 (Permanent Ban): Applied for identity theft of medical experts, disclosing patient secrets, severe copyright infringement, or anti-state activities.

VI. INTELLECTUAL PROPERTY RIGHTS

1. Platform Content: Healthcare Insight owns all copyrights regarding the platform’s interface, logos, and proprietary databases.
2. Member Contributions: By sharing content, members grant Healthcare Insight a free, non-exclusive license to use, adapt, and distribute said information for community-building purposes.
3. Citations: Members must credit original authors and provide links when citing medical journals or market research.

VII. COMPLAINT AND DISPUTE RESOLUTION

1. Mechanism: Members may submit complaints regarding service or content violations via:

2. Processing Time: Initial response within 48 business hours.
3. Legal Resolution: If a dispute cannot be settled through negotiation, it shall be referred to the competent courts or arbitration centers in Ho Chi Minh City, Vietnam.

VIII. PRIVACY POLICY AND DATA PROTECTION

1. Data Collection: We collect Name, Phone Number, Email, and Professional Credentials to ensure a high-quality expert network.
2. Storage: Data is stored on secure servers located in Vietnam and will be retained until the member requests account deletion.
3. Disclosure: We commit to not sharing personal data with third parties for marketing purposes without consent, except when requested by state authorities for legal investigations.

IX. LIMITATION OF LIABILITY

Healthcare Insight acts as a platform for information exchange. We are not liable for:

• Any medical outcomes or clinical decisions made based on information shared by members.
• Direct or indirect damages arising from the use of the platform.
• Technical failures due to force majeure (natural disasters, ISP outages).

X. FINAL PROVISIONS

1. Amendments: These terms may be updated at any time. Significant changes will be announced on the platform’s homepage.
