Ho Chi Minh City cosmetic manufacturer suspended following multiple regulatory breaches

The Drug Administration of Vietnam (Ministry of Health) has imposed strict administrative sanctions on GAMMA Pharmaceutical – Cosmetic Production Company Limited, based in Tan Phu District, Ho Chi Minh City, due to significant non-compliance in manufacturing and commercial operations.

Investigations revealed that the company marketed several products with therapeutic claims that deviated from their approved dossiers. Three specific items cited for misleading labeling include Gamma Neoderm plus (October 2023 batch), Gamma Lucci (March 2024 batch), and Gamma Dolly Ac Acnes Gel (August 2024 batch). Furthermore, the product Gamma Vinatid (November 2023 batch) was found to have a chemical composition inconsistent with its registered formulation.

As a result of these systematic violations, the authorities have executed the following measures:

  • Financial penalties: A fine of 95 million VND has been issued, along with the confiscation of over 41.6 million VND in illegal profits, bringing the total payment to over 136 million VND.

  • Operational suspension: The company’s Certificate of Eligibility for Cosmetic Production has been revoked for 1.5 months, effective from January 20.

  • Product recall: All non-compliant batches must be recalled and destroyed, with a progress report submitted to the Ministry of Health within 30 days.

This enforcement action follows previous incidents where other products from the same distributor, including a specialized cleanser, were withdrawn for containing undeclared ingredients. This move reflects the Ministry’s commitment to tightening oversight in the domestic cosmetic market.
