The Ministry of Health is currently seeking public feedback on a draft Decree concerning cosmetics management, aimed at replacing outdated regulations with a focus on streamlining administrative procedures and decentralizing authority. The most significant change in this draft is the complete transition from a “pre-approval” to a “post-market” mechanism, based on the principle of corporate self-responsibility for product safety and legal compliance.
Under the proposed model, cosmetic products will be publicly declared on a centralized electronic system before entering circulation. Regulatory agencies will no longer review dossiers in advance but will instead conduct inspections and monitoring once products are on the market. Should violations regarding prohibited ingredients or ASEAN safety standards be detected, authorities will revoke the registration numbers and impose strict penalties.
The draft also suggests unifying the requirements for issuing Manufacturing Certificates and CGMP standards to enhance the standing of domestic goods. Manufacturing facilities will undergo periodic inspections every three years or unannounced audits to ensure consistent quality maintenance. These reforms are expected to remove administrative hurdles in advertising and labeling, helping businesses reduce cost burdens and boost international competitiveness.
