Starting May 15, 2026, Decree 90/2026/ND-CP regarding administrative sanctions in the health sector will officially take effect. This regulation establishes a specific framework to tighten the management of next-generation tobacco products, which are increasingly prevalent.
Sanctions for individual use and facility management The Decree outlines the following fines and remedial measures:

Personal use: Individuals using e-cigarettes or heated tobacco products will face fines ranging from 3,000,000 VND to 5,000,000 VND.

Facilitating use: Property owners or managers who allow others to use these products on their premises will be fined between 5,000,000 VND and 10,000,000 VND (excluding violations involving immediate family members).

Additional penalties: All e-cigarettes or heated tobacco devices involved in violations must be destroyed.
Regulations on smoking cessation support The Decree also sets standards for cessation counseling facilities, with fines from 1,000,000 VND to 2,000,000 VND for the following failures:

Lack of dedicated areas for direct counseling or official communication materials.

Insufficient telecommunication infrastructure (internet, telephone) for indirect counseling.

Failure to provide written notification to the local Department of Health before commencing operations.
