Decree 90/2026/ND-CP on administrative sanctions in the healthcare sector will officially take effect on May 15, replacing the current Decree 117/2020/ND-CP. The new regulations focus on protecting the safety of medical personnel and preventing profit-seeking or the spread of false information that damages the industry’s reputation.
Protecting the dignity and lives of medical staff One of the most notable highlights is the fine ranging from 30 to 40 million VND for the following acts:

Assaulting, infringing upon the health or life, or insulting the honor and dignity of doctors and staff working at medical facilities.

Damaging or destroying the property of hospitals or healthcare clinics.

Posting information that prematurely assigns blame to practitioners or facilities following medical incidents without official conclusions from competent authorities.
Rectifying professional practice and prescribing The Decree introduces several penalty tiers to strictly control professional ethics:

3 – 5 million VND fine: For practicing without registration or practicing outside of registered times and locations.

5 – 10 million VND fine: For refusing to participate in epidemic or disaster relief when mobilized; exploiting professional status to promote unverified methods; or failing to follow professional procedures.

10 – 20 million VND fine: For prescribing medication inconsistent with the diagnosis and patient’s condition, or including unauthorized products in prescriptions.

20 – 30 million VND fine: For selling or dispensing expired, untraceable, or improperly stored medications.
Supplementary sanctions In addition to financial penalties, individuals committing serious violations may have their professional certificates or operating licenses revoked. These specific regulations aim to create a solid legal framework, ensuring medical staff can work safely in high-pressure environments while safeguarding the legitimate rights of patients.
