A federal jury in Boston has delivered a milestone antitrust verdict against Takeda, finding the Japanese drugmaker liable for conspiring with a competitor to restrict market competition. The case established that the company engaged in an anti-competitive arrangement to hold back the market introduction of a generic alternative to its constipation treatment, Amitiza.
The initial compensation order stands at $885 million, comprising $475 million allocated to direct purchasers and $347 million dedicated to individual retail entities. Under statutory antitrust frameworks in the United States, this damages figure will be automatically tripled to approximately $2.5 billion once the court issues its final formal judgment. The litigation, originally structured as a class-action lawsuit in 2021, was brought forward by an extensive coalition of commercial retailers, medical insurance providers, healthcare funds, and major pharmacy networks.
Historical records indicate that in 2014, Takeda and its partner Sucampo Pharmaceuticals concluded a $210 million settlement with Par Pharmaceutical to resolve pending disputes. Consequently, Par deferred the commercial rollout of its low-cost generic equivalent until 2021, despite the original therapeutic product securing its initial regulatory approval back in 2006. This multi-year delay generated substantial overcharges for corporate buyers and supply chain participants.
Financial performance metrics reveal that global revenue for the medication decreased by roughly 25% during the fiscal period when the generic substitute finally entered the market, dropping from $253 million down to $191 million. Takeda’s commercial licensing rights for the drug subsequently terminated in 2024. The pharmaceutical firm has announced intentions to challenge the trial outcome through post-trial motions and appellate procedures, citing procedural and legal discrepancies.
