Government tightens food safety controls and advertising regulations

To eradicate the rampant issue of counterfeit food and milk products, the Government has enacted Resolution 66.13/2026 and Decree 46, effective from late January 2026. These regulations represent a decisive shift from a relaxed management approach to a rigorous “pre-check” mechanism.

Core changes in quality management:

  • Direct producer accountability: Manufacturers of medical nutrition, infant formula (for children under 36 months), and supplements are now required to hold the product notification themselves, rather than through commercial intermediaries. These facilities must strictly adhere to international standards such as GMP, HACCP, or ISO 22000.

  • Strict pre-inspection process: Product dossiers must now include test reports covering both safety and quality indicators. For imported goods, previous “inspection exemptions” have been abolished. All shipments must now undergo thorough document review and physical sampling before customs clearance.

  • Extended appraisal period: The review time for dossiers has been increased to 90 days to allow professional councils sufficient time for in-depth technical evaluations.

Stricter oversight of advertising and e-commerce: The new legal framework clarifies the responsibilities of stakeholders within the business ecosystem:

  1. E-commerce platforms: They are mandated to verify the legal documentation of products before listing and will share liability for any violations.

  2. Influencers (KOLs): They must explicitly disclose sponsorship relationships. Their claims regarding product benefits will be closely monitored to prevent exaggeration or false advertising.

While tightening oversight, the Ministry of Health is also advancing administrative reforms by decentralizing 80% of procedures to local authorities and significantly reducing processing times for advertising approvals and testing facility designations, ensuring a supportive environment for legitimate businesses to thrive.
