Preparing for New Food Safety Regulations: Enforcement Milestone from April 16

To ensure a seamless transition for upcoming food management regulations, the Ministry of Health has issued a directive urging local authorities to finalize their organizational structures and resources. This follows the Government’s decision to postpone the implementation of Decree 46/2026 and Resolution 66.13 until mid-April 2026.

Adjusting the Roadmap for Resource Optimization The suspension of these new legal documents until the end of April 15, 2026, is a strategic move. This extension allows provinces and cities to strengthen their personnel and infrastructure, preventing procedural confusion when transitioning to new product registration and inspection protocols.

Core Local Preparations The Ministry of Health requested provincial People’s Committees to strictly consolidate their management systems based on key tasks:

  • Defining Jurisdictions: Assigning state inspection duties to specialized agencies and decentralizing management down to the grassroots level.

  • Establishing Testing Networks: Reviewing and publicizing a list of qualified food testing facilities to support monitoring efforts.

  • Digital Transparency: All information regarding inspection bodies and testing laboratories must be transparently listed on official websites for easy access by businesses.

Supporting Businesses and Strengthening Oversight A primary requirement is to maintain smooth trade flows, particularly at border gates, preventing goods from being delayed due to administrative hurdles. Simultaneously, post-market surveillance will be intensified for conformity assessment bodies and international standards such as HACCP, ISO 17025, or FSSC.

The implementation principle is established on the “6 Clears” criteria: clear personnel, clear tasks, clear responsibility, clear authority, clear timing, and clear results, aiming for full readiness by the April 16 deadline.
