The Government has issued Decree No. 90/2026/ND-CP, establishing a strict legal framework to protect breastfeeding and regulate the improper marketing of breast-milk substitutes. Effective from May 15, 2026, this Decree focuses on penalizing misinformation and promotional activities within healthcare facilities and the retail market.
The administrative fines are categorized based on the severity of the violation:

1 to 3 million VND: For spreading misinformation that substitutes are equal to or better than breast milk, or recommending breast-milk substitutes for infants under 6 months without medical advice.

3 to 5 million VND: Penalties for providing inaccurate product information; unauthorized contact with mothers for promotional purposes; failing to provide breastfeeding counseling at clinics; or medical staff accepting gifts and benefits from dairy companies.

5 to 10 million VND: Targeted at healthcare facilities that allow the sale of substitutes (except for hospital pharmacies), display items with product logos, or utilize sponsorships for education and workshops to covertly promote products.

10 to 20 million VND: The highest fines apply to the exhibition of substitutes and complementary foods for infants under 6 months in medical settings, and implementing promotional schemes (samples, vouchers, loyalty points) for breast-milk substitutes.
These regulations reinforce the government’s commitment to prioritizing infant health and mitigating commercial influences that undermine natural breastfeeding practices.
